The agreement for using FetchApp.

By using FetchApp, you agree to these terms. They cover your account, API use, billing, cancellation and the general conditions. The cancellation section explains what happens to your account and data when you leave.

Accepting these terms

By using the FetchApp website or the FetchApp service, you agree to be bound by these terms of service.

We may update and change these terms from time to time. New features that add to or enhance the service are covered by the same terms. Continued use of the service after a change means you accept it. The current version is always at this address, and the date at the top of the page is when it last changed.

Violating any of the terms below can result in your account being terminated. FetchApp prohibits the conduct and content described here, and you understand that we cannot be responsible for conduct or content that other people put on the service. You use the service at your own risk.

Account terms

Your account

  • You must be 13 years or older to use the service.
  • You must be a human. Accounts registered by bots or other automated methods are not permitted.
  • You must give your legal full name, a valid email address, and the other information asked for during signup.
  • A login belongs to one person. Sharing a single login between several people is not permitted, and you can create as many separate logins as you need.
  • You are responsible for keeping your account and password secure. FetchApp is not liable for loss or damage arising from a failure to do that.
  • You are responsible for all content posted and all activity under your account, including content posted by people with logins under your account.
  • One person or legal entity may not maintain more than one free account.
  • You may not use the service for any illegal or unauthorised purpose, and you must not break any law in your jurisdiction, copyright law included.
API terms

Using the API

You can reach your FetchApp account data through the API. Any use of the API, including use through a third-party product that connects to FetchApp, is covered by this agreement plus the terms in this section.

You understand and agree that FetchApp is not liable for any direct, indirect, incidental, special, consequential or exemplary damages, including damages for lost profits, goodwill, use, data or other intangible losses, even where we have been advised that they were possible, arising from your use of the API or of third-party products that use it.

Abuse of the API, or excessively frequent requests, can result in your account’s API access being suspended temporarily or permanently. FetchApp decides at its own discretion what counts as abuse or excessive use, and will make a reasonable attempt to warn the account owner by email first.

We reserve the right to modify or discontinue the API, or any part of it, temporarily or permanently, with or without notice.

Payment and refunds

Billing, upgrades and downgrades

Paying accounts are billed through one of two channels. If you signed up on our own site, a valid credit card is required and we bill you directly. If you installed FetchApp from the Shopify App Store, Shopify bills you as part of your Shopify account and you never give us a card. Free accounts are not asked for payment details either way.

The service is billed in advance each month and is non-refundable. There are no refunds or credits for partial months, for an upgrade or downgrade, or for months left unused on an open account. So that everyone is treated the same way, no exceptions are made.

All fees are exclusive of taxes, levies and duties imposed by a taxing authority, and you are responsible for paying them, excluding United States federal and state taxes.

If you downgrade, your card is charged at the new rate from your next billing cycle. If you upgrade, your card is charged the prorated difference for the rest of the current cycle, and then the new rate from the next one. Downgrading can cost you content, features or capacity, and FetchApp does not accept liability for that loss. What each plan includes →

If you installed FetchApp from the Shopify App Store, Shopify bills you. If you signed up on our own site, we bill you. These are separate subscriptions, and cancelling one does not stop the other.

Cancellation and termination

Cancelling, and what happens to your data

You are responsible for cancelling your own account. An email or a phone call is not a cancellation. You can cancel at any time from the account settings in your admin, and support will do it for you if you write from an address on the account.

Uninstalling FetchApp from your cart does not cancel your account. It removes our access to your store, and the subscription carries on until you cancel it.

Cancelling takes effect immediately. If you cancel partway through a paid month you are not charged again.

When you cancel, your account is taken off the paid plan and moved to the free plan, and any future invoice date is cleared. A live Shopify subscription charge is cancelled with Shopify. Your store credentials are cleared and your other cart connections are removed, so nothing further is delivered. Your handle is renamed, which releases the address for someone else to use. The account record is then marked as closed rather than erased.

We keep a cancellation record with the account name, email address, handle and plan so we can answer later billing questions. Because the account is closed rather than erased, support can reopen it if you cancelled by mistake or you come back. FetchApp may, at its own discretion, suspend or terminate your account and refuse current or future use of the service, for any reason, at any time. Termination can mean your account is deactivated or deleted and the content in it forfeited. We reserve the right to refuse service to anyone.

The service and its price

Changes to the service and to prices

FetchApp may modify or discontinue the service, or any part of it, temporarily or permanently, with or without notice.

Prices, including monthly subscription fees, are subject to change on 30 days notice. Notice may be given by posting the change on the FetchApp site or in the service itself.

FetchApp is not liable to you or to anyone else for a modification, price change, suspension or discontinuation of the service.

Copyright

Who owns what

We claim no intellectual property rights over the material you put into the service. Your profile and the files you upload remain yours. If you set pages to be shared publicly, you accept that others can view and share that content.

FetchApp does not pre-screen content. We and our designees have the right, though not the obligation, to refuse or remove any content available through the service.

The look and feel of the service is copyright FetchApp, all rights reserved. You may not duplicate, copy or reuse any part of the HTML, CSS or visual design without written permission.

Security research

Reporting a vulnerability

If you find a security problem and tell us before you tell anyone else, we will not pursue legal action against you. That undertaking is conditional on all of the following.

  • Test only against an account you own. Do not access, modify or download another customer’s data, files or orders, and stop as soon as you can see that you could.
  • No denial of service, no load or stress testing, no automated scanning at a volume that degrades the service for anyone else.
  • No social engineering of our staff, our customers or our vendors, and no physical access attempts.
  • Report privately to [email protected] with “security” in the subject, and give us a reasonable opportunity to fix it before publishing.
  • Do not use the finding to extract payment. There is no bounty programme, we do not negotiate one, and a report conditioned on payment is not a good-faith report.

This clause applies only when you meet all of the conditions above, even where other provisions in these terms prohibit hacking the service. If you do not meet those conditions, this protection does not apply and we reserve every remedy available to us.

General conditions

General conditions

  • Your use of the service is at your sole risk. It is provided on an as-is and as-available basis.
  • Technical support is provided through our support desk.
  • You understand that FetchApp uses third-party vendors and hosting partners to provide the hardware, software, networking and storage needed to run the service. They are named on the sub-processor list. Sub-processors →
  • You must not modify, adapt or hack the service, or modify another website so as to imply falsely that it is associated with FetchApp.
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the service without written permission.
  • We may, without being obliged to, remove content and accounts holding content we judge unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable, or that violates someone’s intellectual property or these terms.
  • Verbal, physical, written or other abuse, including threats, directed at a FetchApp customer, employee, member or officer results in immediate account termination.
  • You understand that the technical processing and transmission of the service, including your content, may involve transmission over various networks and changes made to fit the technical requirements of connecting networks or devices.
  • You must not upload, post, host or transmit unsolicited email, SMS or spam.
